<li style="font-weight: 400;" aria-level="1">When driving, keep the cannabis product in its sealed container or package in the trunk of your vehicle. </li>
<li style="font-weight: 400;" aria-level="1">You can’t drive while under the influence of cannabis. </li>
<li style="font-weight: 400;" aria-level="1">You may possess an ounce (28.5 grams) of cannabis plant material and 0.28 ounces (8 grams) of concentrated cannabis. </li>

Employers have the right to a drug-free workplace but without discrimination. Since cannabis is considered a Schedule 1 drug under federal law, employers can request a drug test, provided it falls within the legal bounds. 
According to a study by the <a href="https://americanaddictioncenters.org/blog/analysis-employer-drug-testing">American Addiction Centers</a> on Glassdoor job postings and drug screenings, fewer and fewer employers are testing their staff for drugs. In the US, fewer than two percent of jobs require pre-employment drug tests. Thats good news!
Government, healthcare, hospital, and manufacturing positions typically request pre-employment <a href="https://www.greenrush.com/blog/cbd-drug-test">drug tests</a>. Employers in the healthcare, medical, logistics, and transport industries do regular drug screenings. 
Amazon, for example, tests for drugs. But in 2021, the eCommerce giant announced that it would no longer include weed in its comprehensive drug screening program for certain positions. 
<h2>New Protections Proposed: New Bill for Cannabis Consumers </h2>
Laws evolve, albeit slowly. And it’s high time that laws protect cannabis consumers, especially patients.
Legislative debates continue on workplace safety and cannabis intoxication. Nationally, there’s no legal limit for when a person has an unsafe level of THC in their system like there is for alcohol and other drugs. 
No drug test for ganja can accurately measure how frequently or how much pot someone uses. Even a mouth swab drug test. These tests aren't even accurate to determine whether you are currently intoxicated. 
A drug test for weed simply tells your employer you’ve used cannabis at some point in the recent past. Maybe today, maybe yesterday, maybe a month ago. Since <a href="http://blog.greenrush.com/how-long-does-delta-8-stay-in-your-system/">weed can stay in your body</a> for months, failing a drug test is possible even if you haven’t smoked pot for weeks. 
This led to a new bill introduced in the California Assembly in February 2022. <a href="https://openstates.org/ca/bills/20212022/AB2188/">Assembly Bill 2188</a> would amend the Fair Employment and Housing Act and prevent employers from discriminating against employees for using pot recreationally. 
Employees would be safe should they <a href="http://blog.greenrush.com/how-to-pass-a-hair-follicle-test/">fail a weed drug test</a>. However, it’s still illegal to be high at work and use cannabis on the job. Plus, there are exceptions for employees at drug-free workplaces. 
The Democratic Governor of California, Gavin Newsom, has until September 30, 2022, to decide whether this bill should be signed into law. 
If Newsom decides in favor of the bill, it will take effect on January 1, 2024, and California would join six other states (Connecticut, Montana, Nevada, New Jersey, New York, and Rhode Island) that have laws protecting employees and their right to use recreational weed.

Drug Testing in California: New Bill to Protect Cannabis Consumers 

Recently, delta-8 has skyrocketed in popularity, with many users wanting to add the cannabinoid to their lifestyle. You may wonder, “How long does delta-8 stay in your system?” especially if you have an upcoming drug test.

Delta-8, also known as delta-8 tetrahydrocannabinol or delta-8 THC, is a chemical analog or isomer of THC (or delta-9 tetrahydrocannabinol). 
The Cannabis sativa plant has naturally low quantities of the cannabinoid. As such, manufacturers make delta-8 in concentrated amounts from hemp-derived cannabidiol (CBD) through an isomerization process.   
Like “traditional” THC, it is psychoactive, so if you dabble in delta-8 products, you’ll still feel high.  
<h2>What’s the Difference Between Delta-8 and THC? </h2>
Delta-8 and THC (the delta-9 variety) are like fraternal twins. Kind of the same, but different. Both compounds share the THC name (scientifically, at least), induce highs, and can become addictive. 
The first difference is the chemical structure of delta-8 and THC. To the untrained eye, the molecular structure looks identical. On closer inspection, you’ll see that delta-8’s double bond in its carbon ring is located on the eighth carbon atom. Delta-9’s double bond is on the ninth carbon atom. 
This slight chemical distinction is why delta-8 is less potent. The high you get when using delta-8 products is milder — it’s a pleasant, euphoric high where you feel relaxed and more clear-headed than with a delta-9 THC high.     
According to <a href="https://www.ncbi.nlm.nih.gov/pmc/articles/PMC6099582/">a 2018 study</a>, the reason for the less intense high is that delta-8 has a lower affinity for one of the receptors in our endocannabinoid system.
The other significant  difference is the legality of regular THC and delta-8. Currently, marijuana or delta-9 THC is legal for recreational use in <a href="https://www.usnews.com/news/best-states/articles/where-is-marijuana-legal-a-guide-to-marijuana-legalization">20 states</a>. On a federal level, THC is a Schedule 1 drug. Chemically, delta-8 is THC, but producers pull it from hemp. Yes hemp is legal, and yes THC is legal in California, but it's complicated. 
According to the <a href="https://eastbayexpress.com/freak-out-delta-8-thc-has-people-losing-it-and-its-enlightening/">East Bay Express</a>, in 2021 California "made it illegal to sell any [hemp consumer] product with a combined level of THC higher than 0.3% outside the regulated cannabis market."  Which means delta-8 products are technically legal or regulated in our state.
<h2>Does Delta-8 Show up on Drug Tests?  <img class="wp-image-9999 alignright" src="http://blog.greenrush.com/wp-content/uploads/shutterstock_1734787802.jpg" alt="Blue gloved hadn holding urine sample, drug test" width="515" height="344" /></h2>
Delta-8 shows up on <a href="http://blog.greenrush.com/passing-a-drug-test/">drug tests</a> because its chemical structure and molecular weight are similar to that of THC. Additionally, drug tests can detect metabolites from any THC type. 
The challenge, however, is if delta-8 is legal in a state where delta-9 THC is illegal. If a person who has enjoyed delta-8-infused products takes a drug test, it’ll show up as a false positive for delta-9 THC.    
<a href="https://doi.org/10.1002/dta.3190">A 2021 study</a> conducted in Sweden supports this. The study found an “unknown interfering peak” with the exact mass and similar structure to delta-9 THC during routine urine testing. 
Researchers identified the “peak” as delta-8 THC. They concluded that the isomer and others are causing analytical and medico-legal issues because it’s so easily confused with delta-9.   
Even though delta-8 does show up on drug tests, the type of test is an important factor. Urine tests detect delta-8 for up to 48 days, while saliva and blood tests detect the cannabinoid for up to 48 hours.
<h2>How Long Does Delta-8 Stay in Your System?  </h2>
A <a href="https://www.ncbi.nlm.nih.gov/pmc/articles/PMC2689518/">2009 study</a> found that within five days after consuming a THC-infused <a href="http://blog.greenrush.com/all-the-different-types-of-weed-edibles/">edible</a>, tincture, or other product, 80 to 90 percent of the THC is excreted.

Semi-synthetic cannabinoids are psychoactive substances made in a lab, using natural cannabinoids such as CBD or THC as the starting ingredient. 
Non-psychoactive cannabinoids (like the ones found in hemp) can be put through a chemical process that changes their molecular shape and make-up to be similar to THC. As a result, they can stimulate the body’s cannabinoid receptors and get you high.
When we talk about THC, normally we’re referring to Delta-9-tetrahydrocannabinol, which is the compound in cannabis that gets you stoned. Semi-synthetic cannabinoids mimic the structure of Delta-9 THC closely enough that they’re able to get you high, although with slightly different effects.
So why would people create lab versions of THC when it already exists naturally? 
Access to natural THC is limited in states where cannabis is still illegal. Thanks to the 2018 Farm Bill, <a href="http://blog.greenrush.com/cbd-drug-test/">hemp</a> is legal everywhere in the US, so manufacturers claim that semi-synthetics made from hemp are legal, too, and can be sold freely. However, the legality of semi-synthetic cannabinoids is still contested at this stage. 
Legal issues aside, semi-synthetic cannabinoids have also arisen out of experimentation with existing cannabinoids, in order to create different effects recreationally and opening up potential for future medical applications. 
<h2>How Are Semi-Synthetic Cannabinoids Made and Are They Safe?</h2>
<h3>Delta-8 THC <img class=" wp-image-9918 alignright" src="http://blog.greenrush.com/wp-content/uploads/shutterstock_1308714046-300x300.jpg" alt="Delta-8 molecular structure" width="339" height="339" /></h3>
Delta-8 THC is the most popular semi-synthetic cannabinoid and it’s widely available in the form of vape carts, smoking products, and a variety of edibles.
It occurs naturally in cannabis plants, but in such small amounts that it’s not worth the cost of extracting it. Any Delta-8 you find for sale will have been synthesized in a chemical process, which is much cheaper and produces larger amounts. 
Most Delta-8 is made from CBD that is mixed with a solvent and acid and heated for a long time. The chemical conversion is simple and can even be done at home, but the problem is the leftover solvent and acid. This needs to be thoroughly removed once the conversion is complete, or the end product will be contaminated with unsafe chemicals.
This should be done in a fully equipped lab that makes all of its safety data public. If you’re buying Delta-8, you should be able to verify that the lab it comes from has analyzed the product. Can you confirm a lab has given it the all-clear in terms of contaminants?
Is delta-8 safe to consume?
Delta-8 products are unregulated, and adverse effects have been reported. The FDA has issued a <a href="https://www.fda.gov/consumers/consumer-updates/5-things-know-about-delta-8-tetrahydrocannabinol-delta-8-thc">warning</a> to the public due to an increase in adverse events being reported to the Poison Control Center. The warning mentions that some manufacturers might use unsafe chemicals. 
Some states have banned Delta-8 outright due to safety concerns.
<h3>Delta-10-THC</h3>
Delta-10 is also present naturally in cannabis, in amounts too minuscule for extraction. It is harder to synthesize than Delta-8, so this form isn’t as widely available commercially yet. 
<h3>THC-O Acetate</h3>
THC-O acetate doesn’t exist naturally in the cannabis plant. Chemists can only manufacture it in a lab, using either CBD or THC as the base. The process requires acetic anhydride, a toxic and potentially explosiv chemical, which has raised many safety concerns around THC-O.
In an interview with <a href="https://www.hempgrower.com/article/thc-o-acetate-q-and-a-dr-ethan-russo-credo-science/">Hemp Grower</a>, neuroscientist and cannabis research Dr. Ethan Russo M.D. advised people to stay away from it.
“The process of making THC-O acetate is inherently dangerous,” Russo said. “There can be some nasty chemicals involved in the process that really have nothing to do with cannabis per se, but are going to be very, very potentially harmful to the liver or other organs.”
<h2>What Does the High Feel Like?</h2>
The intensity of a high is a subjective experience. It’s difficult to quantify how potent one type is compared to another. With that said, there is some consensus amongst regular consumers. 
Delta-8 is said to offer a similar type of high to natural Delta-9 THC but with a lower intensity. This has earned it nicknames like ‘weed lite’ and ‘diet weed’.
